B. Counter-Notification

If you believe that material you posted on the Site was removed or access to it was disabled due to mistake or misidentification of the material to be removed, you may file a counter-notification with our Copyright Agent.

To be effective, your counter-notification must include the following information:

  1. Identification of the Material: Identify the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.

  2. Your Contact Information: Include your full name, address, telephone number, and email address.

  3. Consent to Jurisdiction Statement: State that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if your address is outside of the United States, the United States District Court for the District of Nevada), and that you will accept service of process from the person who provided the original DMCA Notice or an agent of such person.

  4. Statement Under Penalty of Perjury: Include a statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.

  5. Your Signature: Provide your physical or electronic signature.

Upon receiving a valid counter-notification, we will forward it to the complaining party. The DMCA allows us to restore the removed material after 10 business days, but no later than 14 business days, from the date we receive the counter-notification, unless the copyright owner files a court action seeking a court order to restrain the alleged infringement.

C. Repeat Infringers

We have a policy of terminating, in appropriate circumstances, the accounts of users who are determined to be repeat infringers of copyright. Determination of repeat infringement will be based on a review of multiple DMCA notifications and other relevant factors.
